Nothing in these terms affects your statutory rights as a consumer.
2. About J3 Publishing / Books:
J3 Publishing / Books is an independent, author-led publishing business operating as a sole trader in the United Kingdom.
The publications offered through this website are centred on lived experience, education and identity.
AMUK’AAi is presented publicly as an anonymous author.
The author’s anonymity does not affect the identity, responsibilities or legal obligations of the business operating this website and supplying its products.
3. Use of the Website:
You may use this website only for lawful purposes.
You must not:
- use the website fraudulently or unlawfully;
- interfere with the website’s operation or security;
- attempt to gain unauthorised access to the website, store or associated systems;
- introduce viruses, malicious software or harmful material;
- copy, reproduce or commercially exploit website content without permission;
- submit false, misleading or abusive information; or
- use the website in a way that infringes another person’s rights.
We may restrict or suspend access where reasonably necessary to protect the website, the business, customers or third parties.
4. Age and Legal Capacity:
You must be at least 18 years old and legally capable of entering into a contract to place an order.
If you are under 18, an order must be placed or authorised by a parent or legal guardian.
5. Products:
J3 Publishing / Books may offer:
- printed books;
- eBooks and other digital downloads;
- booklets and educational publications; and
- other publishing-related physical products or merchandise.
Product descriptions, formats, prices and availability are displayed on the relevant product page.
We take reasonable care to ensure that product descriptions and images are accurate.
Colours and appearance may vary slightly depending on screen settings, printing processes and materials.
Any material difference affecting the nature or use of a product will be stated on the relevant product page.
6. Nature of the Publications:
J3 Publishing / Books publishes lived-experience material.
The author writes from personal experience and does not present himself as a clinician, medical professional, therapist, teacher or spokesperson for everybody who shares similar experiences.
Publications and website content are not medical, psychiatric, psychological, legal or other professional advice.
They must not be used as a substitute for advice, diagnosis or treatment from an appropriately qualified professional.
Nothing in this section removes or restricts any legal responsibility relating to the quality, description or supply of a product.
7. How to place an order:
- To place an order, you must:
- select the required product;
- review the product description, format and price;
- add the product to the online basket;
- provide the required billing, delivery and contact information;
- select an available payment and delivery option;
- review and correct the order before payment;
accept the applicable terms and any required digital-download acknowledgement; and
select the final payment button confirming that the order carries an obligation to pay.
The website allows you to review and correct the information entered before submitting the order.
Orders are currently completed in English.
These terms are available on the website and may be saved or printed for future reference.
8. Order Receipt and Contract Formation:
After an order is submitted, an electronic acknowledgement or receipt may be sent automatically.
This confirms that the order has been received but does not necessarily mean that it has been accepted.
For physical products, the contract is formed when we send confirmation that the order has been accepted and dispatched.
For digital content, the contract is formed when we accept the order and send confirmation making the digital content available for access or download.
If payment has been taken but the order cannot be accepted, the payment will be refunded.
We may refuse or cancel an order where:
- the product is unavailable;
- payment cannot be authorised;
- the order information appears materially incorrect or fraudulent;
- an obvious pricing or description error has occurred;
- delivery cannot be made to the supplied address; or
- accepting the order would be unlawful.
If an obvious pricing error is identified, we may contact you to offer the product at the correct price or cancel the order and issue a refund.
9.Contract Confirmation:
We will provide confirmation of the contract by email or another durable format that you can retain.
The confirmation will include or provide access to the relevant order information and terms.
For digital content supplied immediately, the confirmation will also record the customer’s request for immediate supply and acknowledgement concerning the cancellation right.
You are responsible for providing a correct and accessible email address.
10. Prices and Payment:
Prices are shown in pounds sterling unless another currency is clearly displayed.
The total price, applicable taxes, delivery charges and other compulsory costs will be shown before the order is submitted.
Payment must be made using one of the payment methods displayed at checkout.
Payments are processed through third-party payment providers. J3 Publishing / Books does not directly store complete payment-card details.
Payment providers may apply their own security checks and terms.
Where an international payment or currency conversion is involved, the customer’s bank or payment provider may apply separate conversion rates or charges.
11. Digital Content and eBooks:
Digital products are supplied in the format described on the product page.
Information about relevant functionality, format and compatibility will be provided before purchase where applicable.
The customer is responsible for checking that their device and software can open the stated file format.
A digital purchase gives the customer a personal, limited and non-transferable right to access and use the content for lawful personal use.
The customer must not:
- reproduce or distribute the digital file;
- upload it to file-sharing services;
- sell, sublicense or transfer it;
- remove copyright or ownership information; or
- use it for unauthorised commercial purposes.
Copyright and all other intellectual-property rights remain with the relevant rights holder.
12. Immediate Digital Supply and Cancellation Rights:
Before digital content is supplied immediately, the customer must:
- expressly request that supply begins during the 14-day cancellation period; and
- acknowledge that the right to cancel will be lost once supply of the digital content begins.
This consent and acknowledgement must be given through a clear, separate action during checkout and will be recorded in the order confirmation.
Once supply begins following that express request and acknowledgement, the customer loses the right to cancel merely because they have changed their mind.
If the legally required consent and acknowledgement have not been obtained, the customer retains the cancellation rights provided by law.
This does not affect the customer’s rights where digital content is faulty, not as described or otherwise fails to meet legal requirements.
13. Problems With Digital Content:
Digital content must be:
- of satisfactory quality;
- fit for its stated or agreed purpose; and
- as described.
If digital content does not meet these requirements, the customer may be entitled to repair or replacement, where possible.
If repair or replacement is impossible, unsuccessful or cannot be provided within a reasonable time without significant inconvenience, the customer may be entitled to an appropriate price reduction, which may be up to the full purchase price.
If faulty digital content causes damage to a customer’s device or other digital content because reasonable care and skill were not used, the customer may also have a legal right to repair or compensation.
To report a digital-content problem, contact, contact@j3publishing.co with the order details and a description of the issue.
14. Physical Product Delivery:
Available delivery destinations, methods, charges and estimated times will be displayed during checkout.
Unless a different period has been agreed, physical goods will be delivered without undue delay and no later than 30 days after the contract is formed.
Delivery dates are estimates unless expressly agreed as binding.
We are not responsible for delays caused by events genuinely outside our reasonable control, but this does not remove any legal right to cancel or receive a refund where the law provides one.
You must provide a complete and accurate delivery address.
Additional delivery charges caused by an incorrect address may be charged where reasonable and lawful.
Risk in physical goods passes to the customer when the goods are delivered to the customer or a person identified by the customer to receive them.
Ownership passes once full payment has been received and the goods have been delivered.
15. International Orders:
Where international delivery is offered, the customer is responsible for checking whether the product may lawfully be imported into the destination country.
Unless checkout states otherwise, the customer is responsible for import duties, customs charges and local taxes imposed by the destination country.
Customs procedures may cause delays outside our reasonable control.
Nothing in these terms removes mandatory consumer rights that apply to the customer under applicable law.
16. Cancelling an Order for Physical Goods:
A consumer purchasing physical goods online normally has the right to cancel without giving a reason.
The cancellation period ends 14 days after the day on which the customer, or a person nominated by the customer other than the carrier, receives the goods.
Where one order contains multiple goods delivered separately, the cancellation period ends 14 days after receipt of the final item.
To cancel, the customer must send a clear statement of the decision to cancel to:
Email: contact@j3publishing.co
The model cancellation form at the end of these terms may be used, but it is not compulsory.
The cancellation notice must be sent before the cancellation period expires.
17. Returning Cancelled Physical Orders:
After notifying us of cancellation, the customer must return the goods without undue delay and no later than 14 days after giving notice of cancellation.
Returns should be sent to:
J3 Publishing / Books
[124-128 City road, London EC1 v2NX
Unless the goods are faulty, incorrect or not as described, the customer is responsible for the direct cost of returning them.
The customer is responsible for taking reasonable care of the goods while they are in their possession.
The customer may inspect the goods as they would reasonably be able to inspect them in a shop. We may make a lawful deduction from the refund where handling beyond what is reasonably necessary has reduced the value of the goods.
Customers should obtain and retain proof of posting.
18. Refunds Following Cancellation:
Where a physical order is validly cancelled, we will refund:
- the price paid for the returned goods; and
- the cost of the least expensive standard delivery method offered by us.
Any additional amount paid for premium or expedited delivery is not required to be refunded beyond the cost of standard delivery.
The refund will be made without undue delay and no later than 14 days after
- the goods are received back; or
- the customer provides evidence that the goods have been returned,
whichever occurs first.
The refund will normally be made using the original payment method unless another method is expressly agreed.
No fee will be charged for issuing the refund.
19. Faulty, Damaged, Incorrect or Misdescribed Physical Goods:
Physical goods must be:
- of satisfactory quality;
- fit for their stated or agreed purpose; and
- as described.
Customers have statutory remedies where goods are faulty, damaged, incorrect or not as described.
Depending on the circumstances and applicable timescales, these may include rejection and refund, repair, replacement or a price reduction.
Where a customer exercises the legal short-term right to reject faulty goods, that right generally applies within 30 days of delivery.
J3 Publishing / Books will pay reasonable return costs where goods are faulty, damaged, incorrect or not as described.
Customers should contact contact@j3publishing.co with:
- their name;
- order number;
- a description of the problem; and
- photographs where these can reasonably help establish the issue.
J3 Publishing / Books is not responsible for damage caused after delivery by misuse, accident, neglect, improper handling or other damage caused by the customer or a third party.
This does not affect the customer’s statutory rights where the goods were faulty, damaged, incorrect or misdescribed when supplied.
Requesting this information does not remove or restrict the customer’s statutory rights.
20. Exceptions to Change-of-Mind Cancellation:
The legal right to cancel may not apply to certain products where an exemption recognised by law applies, including goods made to a customer’s specification or clearly personalised.
Any applicable exception will be stated clearly before purchase.
This section does not remove a customer’s rights where a product is faulty, incorrect or not as described.
21. Complaints and Customer Support:
Questions, order problems and complaints should be sent to:
Email: contact@j3publishing.co
Please include sufficient information to identify the order and understand the issue.
We will acknowledge and investigate complaints within a reasonable period.
Customers are encouraged to contact us so that we have an opportunity to resolve the matter.
This does not restrict a customer’s right to contact their bank, payment provider, card provider, consumer-advice service, regulator or court.
Where a consumer complaint cannot be resolved directly, we will provide information about any certified alternative dispute-resolution body that is legally applicable and state whether we are required or prepared to use that process.
22. Intellectual Property:
Unless otherwise stated, the website and its contents—including publications, writing, artwork, covers, logos, trade marks, designs, graphics and digital files—are owned by or licensed to J3 Publishing / Books and the relevant rights holders.
Purchasing a physical or digital product does not transfer copyright or other intellectual-property rights.
Website content may be viewed for personal and non-commercial purposes.
No content may be copied, reproduced, adapted, republished, distributed, sold or commercially exploited without prior written permission, except where permitted by law.
The J3 thumbprint identity, associated branding and publication artwork must not be used without authorisation.
23. Third-Party Services and Links:
The website may use or link to third-party services, including hosting, online-store, payment and delivery providers.
Third-party websites and services may be governed by their own terms and privacy policies.
We are not responsible for the independent content of external websites that we do not control.
However, using a third-party provider does not remove any legal responsibility that J3 Publishing / Books has to its customers.
24. Website Availability:
We aim to keep the website available and accurate but cannot guarantee uninterrupted access.
Access may be suspended temporarily for maintenance, security, technical problems or circumstances outside our reasonable control.
We may update, withdraw or change website content and product availability where reasonably necessary.
This does not affect contracts already formed or statutory consumer rights.
25. Liability:
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of statutory consumer rights; or
- any other liability that cannot legally be excluded.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable when the contract was formed, or for business losses arising from a consumer purchase.
Nothing in these terms limits any remedy provided by consumer law.
26.Events outside our reasonable control:
We are not responsible for delay or failure caused by an event genuinely outside our reasonable control.
Where such an event affects an order, we will contact the customer where reasonably possible and take reasonable steps to reduce the effect of the delay.
If performance becomes impossible or a delay becomes substantial, the customer may cancel where the law permits and receive a refund for products not supplied.
27. Privacy and Cookies:
Personal information is handled in accordance with the J3 Publishing / Books Privacy Policy.
The website’s use of cookies and similar technologies is explained in the Cookie Policy and through the website’s privacy settings.
The Privacy Policy and Cookie Policy form separate notices and should be read alongside these terms.
28. Changes to These Terms:
We may update these terms to reflect changes in the business, website, products, services or law.
Revised terms will apply from the date they are published and will not retrospectively change a contract already formed.
An order remains governed by the version of the terms accepted when the order was placed.
The current “Last updated” date will be displayed at the top of this page.
29. Severability:
If any part of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.
30. No Waiver:
If we do not immediately enforce a provision of these terms, this does not mean that we have waived the right to enforce it later.
31. Third-Party Rights:
Unless expressly stated otherwise, these terms do not give any person other than the customer and J3 Publishing / Books a right to enforce them.
32. Governing Law and Jurisdiction:
These terms and contracts made through this website are governed by the law of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections available under the law applying where you live and may bring proceedings in the courts available to you under applicable consumer law.
International consumers retain any mandatory legal protections that cannot lawfully be excluded.
